The claim that managers have a fiduciary duty to shareholders to run the corporation in their interests is generally supported by two arguments: that shareholders are owners of a corporation and that they have a contract or agency relation with management. The latter argument is used by Kenneth E. Goodpaster, who rejects a multi-fiduciary, stakeholder approach on the grounds that the shareholder-management relation is “ethically different” because of its fiduciary character. Both of these arguments provide an inadequate basis for the (...) fiduciary duties of officers and directors of corporations. The basis is to be found, rather, in considerations of public policy, a point that was established in the Dodd-Berle exchange of the 1930s. This conclusion also shows the inadequacy of Goodpaster’s solution to the so-called stakeholder paradox, and an alternative solution to the paradox is presented. (shrink)

A relativistic one-particle, quantum theory for spin-zero particles is constructed uponL 2(x, ct), resulting in a positive definite spacetime probability density. A generalized Schrödinger equation having a Hermitian HamiltonianH onL 2(x, ct) for an arbitrary four-vector potential is derived. In this formalism the rest mass is an observable and a scalar particle is described by a wave packet that is a superposition of mass states. The requirements of macroscopic causality are shown to be satisfied by the most probable trajectory of (...) a free tardyon and a nontrivial framework for charged and neutral particles is provided. The Klein paradox is resolved and a link to the free particle field operators of quantum field theory is established. In the United States, interest in urban agriculture has grown dramatically. While community gardens have sprouted across the landscape, home food gardens—arguably an ever-present, more durable form of urban agriculture—have been overlooked, understudied, and unsupported by government agencies, non-governmental organizations, and academics. In part a response to the invisibility of home gardens, this paper is a manifesto for their study in the Global North. It seeks to develop a multi-scalar and multidisciplinary research framework that acknowledges the garden’s social and ecological (...) or material dimensions. Given the lack of existing research, we draw on the more extensive literature on home gardens in the South and community gardens in the North to develop a set of hypotheses about the social-ecological effects of urban home food gardens in the North. These gardens, we hypothesize, contribute to food security, community development, cultural reproduction, and resilience at multiple scales; conserve agrobiodiversity; and support urban biodiversity. They may also have negative ecological effects, such as stormwater nutrient loading. Because of the entanglement of the social and the ecological or material in the garden, we review three theoretical perspectives—social ecological systems theory, actor-network theory, and assemblage theory—that have been or could be applied to the multi-scalar and multidisciplinary study of the garden. We also review sampling and analytic methods for conducting home garden research. The paper concludes with a discussion of opportunities to extend the research agenda beyond descriptive analysis, the primary focus of garden research to date. (shrink)

The authors were involved in developing an ethical framework to assist the Queens Region Board (Prince Edward Island, Canada) set priorities in health and health care. Two and one half years after the adoption of this framework, the authors undertook an evaluation of the framework. This paper will discuss: a) the historical background of regionalization in Canada, and in particular the circumstances leading up to the institution of regional boards in Prince Edward Island; b) the sorts of ethical issues facing (...) the Queens Regional Board; c) issues arising in connection with the use and development of ethics frameworks for managing ethical issues in priority setting; d) the framework adopted by the Queens Board and the process that led to its development; e) issues arising as concerns implementation of the framework; f) questions and issues pertinent to other boards and bodies considering similar initiatives. Wolfgang Stegmüller, the leading German philosopher of science, considers the status of scientific revolutions the central issue in the field ever since "the famous Popper-Lakatos-Kuhn discussion" of a decade and a half ago, comments on "almost all contributions to this problem", and offers his alternative solutions in a series of papers culminating with, and summarized in, his recent "A Combined Approach to Dynamics of Theories. How To Improve Historical Interpretations of Theory Change By Applying Set Theoretical Structures", published in Gerard (...) Radnitzky and Gunnar Andersson, editors, The Structure and Development of Science, issued in the Boston Studies in the Philosophy of Science series, volume 59, 1979, pp. 151-86. Popper views scientific revolutions as rational and due to empirical refutations, but there are no refutations in science. Lakatos agrees and assumes that research programs are refutable and their replacements to be revolutions, but the same arguments he launches against Popper apply to him; moreover, applying his philosophy to itself makes it collapse anyway . Kuhn's view was interpreted to be one of scientific revolutions as quite irrational and as arbitrary as mob action. Stegmüller presents revolution in another interpretation of Kuhn - as non-rational, as based on hopes and value judgment but not on facts. He thinks there are big and small revolutions. And he uses his own modifications of J. D. Sneed's famous formal analysis of scientific theory to make his point. After presenting a summary of Stegmüller's ideas in our own way, which seems to us a clarification of presentation with no change of content, especially due to our stressing all differences of opinion, we apply Stegmüller's idea to itself, the way Stegmüller has done with the view of Lakatos, and with similar results. This study analyzes cognitive responses to explore a dual processing perspective of ethical judgment formation. Specifically, the study investigates how two factors, judgment task difficulty and moral intensity, influence the extent of deontological and teleological processing and their effects on ethical judgments. A single experiment on 110 undergraduate research participants found that judgment task difficulty affected the extent of deontological and teleological processing. Although moral intensity affected ethical judgments, it did not produce effects on either deontological or teleological cognitive responses. (...) Results did not support the hypotheses that deontological and teleological cognitive responses would mediate the relationships between the experimental factors and ethical judgments. Overall, the results support continued research of factors that affect the nature of information processing in ethical decision situations and the use of cognitive response analysis as a tool for conducting this research. It is generally accepted that farmers manage a complex farm system. In this article we seek answers to the following questions. How do farmers perceive and understand their farm system? Are they sufficiently aware of their farm system that they are able to represent it in the form of a map? The research reported describes how causal mapping was applied to sheep/beef farmers in New Zealand and shows that farmers can create maps of their farm systems in ways that allow (...) expression of both individual maps and the formation of group maps which represent the general character of farm systems. A group map was made for all the farmers studied and for subgroups using conventional, integrated, and organic management systems. The results are discussed in terms of the depth of meaning associated with individual elements of the map, map complexity and the limitations of causal mapping. Causal mapping has the potential to contribute to our knowledge of how farmers see their farm systems, and this can benefit farmers and other stakeholders concerned with the management of farms and their economic and environmental performance. Strict finitism is a minority view in the philosophy of mathematics. In this paper, we develop a strict finite axiomatic system for geometric constructions in which only constructions that are executable by simple tools in a small number of steps are permitted. We aim to demonstrate that as far as the applications of synthetic geometry to real-world constructions are concerned, there are viable strict finite alternatives to classical geometry where by one can prove analogs to fundamental results in classical geometry. The experimental confirmation of nonlocality has renewed interest in Bohm's quantum potential. The construction of quantum potentials for relativistic systems has encountered difficulties which do not arise in a parametrized formulation of relativistic quantum mechanics known as Relativistic Dynamics. The purpose of this paper is to show how to construct a quantum potential in the relativistic domain by deriving a relativistically invariant quantum potential using Relativistic Dynamics. This article provides a detailed examination of Bernard Lonergan’s nuanced understanding of experience and proposes his philosophical stance of critical realism as a foundation for interreligious dialogue. The article begins by acknowledging the existent tension between philosophers and theologians and suggests the problematic of interreligious dialogue as one field of possible collaboration. Critical realism is discussed in comparison to other, and indeed contrasting, positions, and is ultimately defended as the stance that provides correct answers to the so-called ‘three basic questions’ (...) of cognitional theory, epistemology, and metaphysics. The notions of patterns of experience and bias are particularly emphasized in order to highlight the complexity of experience. By way of conclusion, suggestions are made as to how philosophers and theologians might enhance their collaboration by furthering their understanding of religiousexperience and employing it as a category in interreligious dialogue. This paper is an analysis of the reasoning behind Megan’s Laws, which pertain to the notification of communities when convicted sex offenders move into the area, especially those offenders who have carried out crimes against children. Liberals tend to criticize these laws and often point to the value of privacy, which they claim would be unacceptably compromised by allowing them. Communitarians tend to endorse these laws and often point to the value of safety, which they claim would be unacceptably compromised (...) were it not for such laws. Both sides also rely on the notion of human dignity in support of their arguments. The community mining space remains contested for a range of complex reasons. This inherently difficult discursive space is made most apparent in the context of international development where mining is often viewed as a potential lever in the effort to lift poorer nations out of poverty. In this article, the authors offer a critical review of community development (CD) approaches that are currently being applied by the mining sector. While the authors acknowledge recent positive developments in this domain, there remains (...) a good deal of scope for improving the internal standing of, and the external influence over, CD practice in mining. Drawing on the contemporary CD literature, the authors assert “assets” as one possible heurism for enhancing this discursive space by highlighting the ways in which community and company representatives may be able to participate more actively in dialogical processes—both between and within company and community—where development discourse is not prefigured or biased against participating parties.
